In a shocking turn of events, former Prime Minister Imran Khan and his wife, Bushra Bibi, have been handed a seven-year jail sentence in connection with a case related to their Nikkah during the Iddat period. The verdict was announced by Senior Civil Judge Qudratullah.
Legal Proceedings and Statements Recorded
Imran Khan and Bushra Bibi faced legal action under Section 342 of the Code of Criminal Procedure, with Mufti Saeed, Khawar Manka, Aon Chaudhry, and Muhammad Latif recording their statements. The accusations revolved around Imran Khan violating Shariah law by marrying his present wife during her Iddat period.
Imran Khan’s Current Legal Situation
This sentencing comes shortly after Imran Khan and his wife received a prison term in the Toshakhana case. The former prime minister has been in jail since August 2023, facing multiple trials.
Bushra Bibi Denies Accusations
In her defense, Bushra Bibi refutes the allegations, declaring her divorce in November 2017 as a sham. According to her, Kahwar Maneka divorced her in April 2017, and she completed her waiting period by August. She claims to have married Imran Khan in January the following year after completing her Iddat, meeting him in the presence of her family before January 1, 2018.
Furthermore, Bushra insists that the event was not a Nikkah but a gathering for prayers, dismissing the case as illegitimate and un-Islamic.
PTI’s Response and High Court Appeal
Following the controversial verdict, Pakistan Tehreek-e-Insaaf (PTI) announced its intention to approach the high court against the sentence in the Nikah case. Barrister Gohar Ayub, a senior leader of the party, criticized the trial court judge for not providing them with the verdict copy and claimed political victimization ahead of elections.
Understanding Iddat Period in Shariah
In Shariah, Iddat refers to the period a woman must observe after the death of her husband or after a divorce. During this time, the woman cannot marry another man and must adhere to certain practices.
The Nikkah Ceremony and Mufti Saeed’s Testimony
Imran Khan and Bushra Bibi tied the knot in February 2018, with Mufti Saeed solemnizing their Nikah in DHA. According to Mufti Saeed, he inquired about Bushra’s previous marriage and separation before officiating the Nikah. He claimed that a woman, purportedly Bushra Bibi’s sister, assured him that all Shariah requirements were met.
However, Mufti Saeed revealed that Khan approached him again in February 2018, seeking another Nikah with the same woman, alleging that the initial one went against Islamic principles. He disclosed being informed about the Nikah during Bushra Bibi’s Iddat, suggesting that Khan hurriedly married her to secure the premiership.
Serious Allegations of Un-Islamic Marriage
Imran Khan and Bushra Bibi faced serious allegations of intentionally entering into an un-Islamic marriage for the sake of a prediction, adding another layer of complexity to their legal troubles.
